Your TOS seems to make you free from responsibility. What are your responsibilities?

The agreement that you read at our site is reflective of the agreement that we have with our data center and it is similar to most of the TOS agreements that I have seen with other service providers. It is very reflective of the realities of keeping data online. There are so many variables outside of our control, that we can not imply protection against threats that may not even exist today, but could be catastrophic tomorrow.

Rather than focus on "what can go wrong," I will offer what we do to make the best possible hosting environment. Our server sits in a major national data center with 24 hour staffing. The facility provides us with both battery and diesel generator power backup. Daily backups are made of the server for the event of a catastrophic failure as well as the ability to create your own backups as often as you want. There are multiple internet backbone providers connected to the data center and our primary and secondary name server IPs use different backbones, giving us redundancy for power, data and connection. The server runs on the Linux operating system, meaning that we are not susceptible to viruses written for Windows (the vast majority of viruses). We also regularly apply patches and upgrades for system robustness and to close known security flaws against those seeking unauthorized access.

In addition to the above, we also provide you with a human support staff in different time zones. Instead of waking a bleary eyed support tech working through the night, we offer qualified staff working through their normal waking hours. Support is always available from phone, email, web trouble ticket and online chat. If you can't get someone when you need them, you aren't trying very hard. Our phone should always ring to one of our staff somewhere in the world, and if you aren't happy with the response you can always call Jonathan.
